In carrying out the missions entrusted to them, Thomas Dolvelde (hereinafter "Thomart") and his delegates undertake to maintain absolute professional secrecy.
2. Thomart undertakes to use all its care in the execution of the work entrusted to it.
3. Thomart in Incourt is solely qualified to definitively agree with the client on the scope, price, and terms of its intervention.
4. Failure to pay an amount when due shall automatically and without further notice result in the accrual of late payment interest at a rate of 16 % per annum until the date of final payment. In the event of non-payment by the due date, a lump-sum amount of 20% of the amount due, with a minimum of 250.00 euros, shall be payable as compensation for damages other than those covered by late payment interest. This lump sum shall only become due 14 days after the debtor has been formally notified by registered letter. Thomart reserves the right to suspend all work in the event of late payment, without the debtor having the right to claim direct or indirect damages.
5. Any claim regarding billing or service provision must be made in writing within 8 days of the invoice date or delivery date. It can never be invoked to delay the payment of due invoices.
6. In the event that documents are shipped to Thomart, the shipment and transport are at the sender's risk. We cannot accept any responsibility for loss, damage, or destruction of documents or other items entrusted to us that result from elements beyond our control, such as fire, theft, force majeure, etc. This list is given for illustrative purposes and is not exhaustive.
7. The above general conditions apply to all work by Thomart, even in the absence of a written contract.
8. Thomart offers a 2-year warranty from the invoice date for products sold.
9. Legal Framework: Thomart disclaims all responsibility in the event of non-compliance with current rules for websites. The client must stay informed of legal obligations. Thomart has complied with current obligations by adding a privacy policy and informing visitors about cookies concerning Google Analytics. If another rule applies once the website is finished, it is up to the client to request the necessary actions from Thomart (or any other web design/webmaster service).
10. WEBMASTER:
– Website: Work begins upon receipt of the 50% deposit form, and the site goes live upon receipt of the full payment.
– The work of a web designer involves creating one or more web pages, installing Google Analytics, the necessary plugins, creating one or more professional email addresses, creating a privacy policy, and GDPR cookie consent.
– The creation of a website is a fixed-price project – a one-time fee (price agreed upon with the client before the work is carried out). For any modifications/changes/additions/publications after the delivery of the work, the service will be billed at €50 excl. VAT/hour.
– Domain and hosting fees are billed annually. In case of non-payment within 4 weeks of the invoice being sent, the site will no longer be hosted and the domain name will be lost.
– Promotion and advertising services (Google Ads, etc.) are charged at €50 ex VAT/hour
11. VIDEO/PHOTO:
– Post-production work begins after receipt of at least 50% of the outstanding balance
– The work is considered complete once the invoice has been settled and the work has been handed over to the client in person.
If the work is sent via a Dropbox link or other hosting, it will remain available for 1 month from the date of sending.
The client authorizes the use and distribution of images for promotional purposes in the interest of the different parties. The images remain the property of Thom’Art according to Belgian copyright laws.
All photos and videos can be used for commercial and media purposes, at the client's discretion, for an indefinite period.
12. REDUCTION:
– Advertising reduction is granted under this contract. By accepting this "sponsors" partnership, the client agrees to add the "Thom'Art" logo to various social media publications.
13. In the event of a dispute, only the Courts of Brussels shall have jurisdiction.
